1. Definitions

"Service" refers to the musical instrument rental services provided by Gifegay.com.

"User," "You," and "Your" refer to individuals who access or use the Service.

"Instrument(s)" refers to any musical equipment rented through our Service, including but not limited to guitars, pianos, drums, and other musical instruments.

2. Service Description

Gifegay.com provides a platform for renting musical instruments to students and musicians. Our Service includes instrument rental, delivery, pickup, and related customer support.

We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time without prior notice.

3. User Obligations

By using our Service, you agree to:

• Provide accurate and complete information during the rental process.
• Use the rented instruments only for their intended purpose and in accordance with any provided instructions.
• Return instruments in the same condition as received, accounting for normal wear and tear.
• Not modify, repair, or alter the instruments without our explicit written consent.
• Keep instruments in a safe, secure environment protected from extreme temperatures, humidity, or other potentially damaging conditions.
• Not sublease or transfer the instruments to any third party.
• Immediately notify us of any damage, loss, or theft of rented instruments.
• Pay all fees, including rental fees, late fees, and damage charges as applicable.

4. Rental Process and Payments

Rental periods begin on the day of instrument delivery or pickup and end on the agreed return date.

Payment must be made in full before the rental period begins unless otherwise specified in a written agreement.

We accept payment methods as specified on our website at the time of rental.

Late returns will incur additional charges at our current daily rate plus applicable fees.

A security deposit may be required for certain instruments, which will be refunded upon the safe return of the instrument in its original condition.

5. Cancellations and Refunds

Cancellations made more than 48 hours before the scheduled rental period may receive a full refund.

Cancellations made within 48 hours of the scheduled rental period may be subject to a cancellation fee of up to 50% of the rental amount.

No refunds will be issued for early returns unless agreed upon in writing by Gifegay.com management.

6. Service Limitations

While we strive to provide high-quality instruments, we cannot guarantee:

• The continuous, uninterrupted availability of our Service.
• That specific instruments will be available at all times.
• That instruments will meet your specific artistic or performance requirements.
• Service in all geographic areas.

We reserve the right to refuse service to anyone for any reason at our discretion.

7. Intellectual Property

All content on Gifegay.com, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Gifegay.com or its content suppliers and is protected by international copyright laws.

You may not reproduce, distribute, display, or create derivative works from any content on our website without our express written permission.

Any feedback, suggestions, or ideas provided by users regarding the Service may be used by us without any obligation to compensate.

8. Liability Limitations

To the maximum extent permitted by law, Gifegay.com shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, data, or business opportunities.
• Any damage to instruments caused by user negligence or misuse.
• Personal injuries related to the use of rented instruments.
• Any damages exceeding the amount paid by the user for the rental service.

Users are responsible for inspecting instruments upon receipt and reporting any pre-existing damage within 24 hours.

9. Indemnification

You agree to indemnify, defend, and hold harmless Gifegay.com, its officers, directors, employees, agents, and suppliers from and against all claims, losses, expenses, damages, and costs resulting from your violation of these Terms and Conditions or any activity related to your account.

10. Insurance and Damages

Users are responsible for all damages beyond normal wear and tear. In the event of damage, theft, or loss, you will be charged the cost of repair or the full replacement value of the instrument.

We strongly recommend that users obtain their own insurance coverage for rented instruments.

11. Dispute Resolution

Any dispute arising from or relating to these Terms and Conditions shall first be resolved through good-faith negotiation between the parties.

If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the applicable commercial arbitration rules.

The arbitration shall be conducted in the jurisdiction of our primary business location.

The language of arbitration shall be English.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Gifegay.com is registered, without regard to its conflict of law provisions.

13. Privacy Policy

Our Privacy Policy, which explains how we collect, use, and protect your personal information, is incorporated into these Terms and Conditions by reference.

14. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.
